  1. About VG Visuals UK

    VG Visuals UK is a not-for-profit creative community supporting photographers, videographers, riders, automotive enthusiasts and independent businesses.

    VG Visuals UK is not currently a registered company or separate incorporated legal entity.

    For the purposes of these Terms:

    “VG Visuals UK”, “we”, “us” and “our” mean James Comery, acting on behalf of the VG Visuals UK community.

    Our contact details are:

    VG Visuals UK should not be described as a registered charity unless charitable status is obtained separately.

  2. Acceptance of these Terms

    By accessing or using the VG Visuals UK website, you agree to comply with these Terms and Conditions.

    These Terms apply to:

    • Visitors to the website
    • Members of the VG Visuals UK community
    • Riders and other participants
    • Photographers and creators displayed on the website
    • Businesses and creators featured by VG Visuals UK
    • Anyone accessing, downloading or sharing material from the website

    Additional terms may apply when attending an Official VG Visuals UK Shoot, joining the VG Visuals UK community or entering into a separate agreement with a photographer.

    Where additional written terms conflict with these website Terms, the more specific written terms will apply to the relevant service or activity.

  3. What VG Visuals UK does

    VG Visuals UK:

    • Organises and promotes Official VG Visuals UK Shoots and community activities
    • Brings together riders, photographers, videographers and automotive creators
    • Promotes independent self-employed photographers
    • Allows visitors to contact photographers directly
    • Supports selected independent businesses and creators
    • Publishes photography, video and other creative media

    VG Visuals UK does not ordinarily charge photographers commission or receive payment for their independent private bookings.

    Unless expressly confirmed otherwise, VG Visuals UK is not the supplier of an independent photographer’s services and is not a party to the agreement between that photographer and their customer.

  4. Independent photographers

    Photographers and creators featured by VG Visuals UK operate as independent self-employed professionals.

    Each photographer is responsible for their own:

    • Prices and quotations
    • Deposits and payments
    • Tax and National Insurance
    • Insurance
    • Equipment
    • Availability
    • Booking terms
    • Cancellations and refunds
    • Editing and delivery times
    • Customer service
    • Legal and professional obligations

    A photographer’s appearance on the VG Visuals UK website does not make them an employee, partner or legal representative of VG Visuals UK.

    Photographers do not have authority to enter into contracts, accept liabilities or make commitments on behalf of VG Visuals UK unless they have been expressly authorised in writing.

    VG Visuals UK does not guarantee the availability, pricing, performance or suitability of any independent photographer.

  5. Official VG Visuals UK Shoots

    An Official VG Visuals UK Shoot is a shoot, event or creative project that is:

    • Organised or commissioned by VG Visuals UK
    • Advertised or promoted as an official VG Visuals UK activity
    • Operated through the VG Visuals UK community
    • Branded as a VG Visuals UK event
    • Expressly confirmed in writing as an Official VG Visuals UK Shoot before the media is created

    A photographer’s association with VG Visuals UK does not automatically make all their work VG Visuals UK work.

    A booking does not become an Official VG Visuals UK Shoot merely because:

    • The customer discovered the photographer through VG Visuals UK
    • The photographer is featured on the VG Visuals UK website
    • The photographer is a member of the VG Visuals UK community
    • VG Visuals UK introduced the customer to the photographer

    Official VG Visuals UK Shoots may be subject to separate participant, safety, privacy and media-use terms.

    5b. Deposits for Official VG Visuals UK Shoots

    VG Visuals UK may require a deposit to reserve a participant’s place at an Official VG Visuals UK Shoot.

    The amount of the deposit and any remaining balance will be communicated before payment is made. By paying the deposit, the participant confirms that they:

    • Have read and accepted these Terms and Conditions
    • Agree to any additional written terms supplied for the relevant Official VG Visuals UK Shoot
    • Understand that their place is not confirmed until the required deposit has been received
    • Agree to pay any outstanding balance by the stated payment deadline

    Deposits are non-refundable where a participant cancels their booking, does not attend the shoot or otherwise chooses not to take part, except where VG Visuals UK gives special consideration or where a refund is required by law.

    The deposit contributes towards reserving the participant’s place and the costs, preparation and commitments associated with organising the Official VG Visuals UK Shoot.

    5b.1 Cancellation by VG Visuals UK

    Where VG Visuals UK cancels the entire Official VG Visuals UK Shoot, participants will receive a full refund of all deposits and other booking payments made directly to VG Visuals UK for that shoot.

    The booking will not be automatically transferred or rescheduled to another date.

    A photographer, videographer or other individual withdrawing from the shoot does not by itself mean that the Official VG Visuals UK Shoot has been cancelled.

    The shoot will only be treated as cancelled by VG Visuals UK where VG Visuals UK expressly confirms that the official activity will no longer take place.

    VG Visuals UK will not be responsible for additional expenses incurred by a participant, including travel, accommodation, vehicle preparation or other third-party costs, unless otherwise agreed in writing or required by law.

    5b.2 Special consideration

    VG Visuals UK may, at its discretion, give special consideration to a participant’s cancellation request. Each request will be assessed individually. VG Visuals UK may request reasonable supporting information before making a decision.

    Special consideration does not automatically entitle the participant to a refund, credit, transfer or other compensation.

    Where special consideration is granted, VG Visuals UK may offer:

    • Credit towards a future Official VG Visuals UK Shoot
    • A partial refund
    • A full refund
    • Another reasonable arrangement agreed with the participant

    Any decision made under this section applies only to the individual request and does not create a precedent or obligation to provide the same outcome in another case.

    Nothing in this section affects any statutory consumer rights or any refund that must be provided by law.

  6. Independent private bookings

    An Independent Private Booking is a shoot arranged, priced, accepted and delivered independently by a photographer.

    For an Independent Private Booking:

    • The customer contracts directly with the photographer.
    • Payment is made directly to the photographer.
    • The photographer controls the booking and service.
    • The photographer is responsible for cancellations, refunds, delivery and complaints.
    • Copyright normally remains with the photographer unless a separate written agreement states otherwise.
    • VG Visuals UK does not acquire copyright merely because it introduced or promoted the photographer.
    • VG Visuals UK is not responsible for the photographer’s performance of the booking.

    Questions or complaints about an Independent Private Booking should first be addressed directly to the photographer concerned.

  7. Ownership of Official VG Visuals UK Media

    For these Terms, Official VG Visuals UK Media includes photographs, video footage, films, audio, edits, graphics and other creative material produced specifically for an Official VG Visuals UK Shoot.

    Copyright in Official VG Visuals UK Media is owned or controlled by VG Visuals UK where the creator has assigned or licensed those rights under a separate written agreement.

    Nothing on this website alone transfers copyright from a photographer or creator to VG Visuals UK.

    Once the relevant rights have been assigned, VG Visuals UK may:

    • Store and archive the media
    • Select which material is published
    • Edit, crop, resize, colour-grade or retouch it
    • Publish it on websites and social-media platforms
    • Use it to promote VG Visuals UK activities
    • Supply agreed copies to participants
    • License approved third-party use
    • Take appropriate action against unauthorised use

    Copyright ownership does not remove any applicable privacy, confidentiality or data-protection obligations.

  8. Photographer portfolio permission

    A photographer who personally creates media at an Official VG Visuals UK Shoot may display that media through:

    • Their personal or professional social-media accounts
    • Their photography website
    • Their professional portfolio
    • Portfolio and gallery platforms
    • Posts promoting their own photography services

    The photographer does not need to request VG Visuals UK’s permission each time they publish work they personally created.

    This permission:

    • Is non-exclusive
    • Is royalty-free
    • Does not transfer copyright ownership back to the photographer
    • Applies only to material personally created by that photographer
    • Does not permit the photographer to authorise third-party use

    Photographers must not, without written approval from VG Visuals UK:

    • Sell or sublicense Official VG Visuals UK Media
    • Supply it to a brand for commercial advertising
    • Supply it to a publication for commercial use
    • Give another person permission to reproduce it
    • Distribute RAW files, unedited footage or project files
    • Claim ownership of copyright after it has been assigned

    Publication remains subject to any agreed:

    • Embargo or release date
    • Confidentiality requirement
    • Participant privacy restriction
    • Safeguarding concern
    • Reasonable legal removal request

    Where practical, photographers should identify that the media was created at an Official VG Visuals UK Shoot.

  9. Participant use of VG Visuals UK Media

    Receiving, appearing in or downloading VG Visuals UK Media does not transfer copyright ownership.

    Unless VG Visuals UK agrees otherwise in writing, a participant receiving completed media may use it for:

    • Personal social-media posts
    • Personal profile images
    • Personal wallpapers
    • Non-commercial personal prints
    • Sharing with friends and family for personal use

    Participants may not, without written permission from VG Visuals UK:

    • Sell the media
    • Use it in paid advertising
    • Supply it to a business, sponsor or commercial brand
    • Submit it to a publication for commercial use
    • License it to another person
    • Claim that they own the copyright
    • Remove a watermark where one has been applied
    • Distribute RAW files or unedited footage
    • Use the media in merchandise or products for sale
    • Use the media in a misleading, unlawful or defamatory way

    Reasonable cropping for social-media presentation is permitted, provided it does not remove a watermark or materially misrepresent the work.

    Commercial-use permission must be agreed separately in writing.

  10. RAW files and working material

    Unless expressly agreed in writing, VG Visuals UK does not supply:

    • RAW photographs
    • Unedited video footage
    • Rejected images
    • Test images
    • Project files
    • Editing timelines
    • Working files
    • Unfinished material

    VG Visuals UK may decide which images or footage meet the required technical and creative standard.

    Publication of selected media does not create an obligation to release every photograph or piece of footage captured.

    VG Visuals UK does not guarantee permanent storage of galleries, original files or completed media. Recipients are responsible for securely retaining their delivered copies.

    Specific retention periods will be addressed in the VG Visuals UK Privacy Notice and relevant shoot documentation.

  11. VG Visuals UK name, logo and branding

    The VG Visuals UK logo, original visual identity, website design, written content, graphics and other qualifying original material are proprietary to VG Visuals UK or used by VG Visuals UK with permission.

    The VG Visuals UK name is a trading name and brand. It should not be represented as a registered trade mark unless registration is obtained.

    You may not use the VG Visuals UK name, logo or branding:

    • Without prior written permission
    • In a way that suggests an official partnership
    • In a way that suggests VG Visuals UK approval or endorsement
    • To advertise an event as an Official VG Visuals UK Shoot
    • On merchandise or products for sale
    • In another business’s name, branding or social-media identity
    • In a misleading, defamatory or damaging manner

    Permission to participate in a VG Visuals UK activity does not grant permission to reproduce VG Visuals UK branding.

    Any authorised use must follow the format and conditions specified by VG Visuals UK.

  12. Third-party names and logos

    Business names, logos, trade marks and branding displayed within the Worth knowing. section or elsewhere on the website remain the property of their respective owners.

    They are displayed with permission for the purpose of identifying independent businesses and creators supported by VG Visuals UK.

    Their inclusion:

    • Does not transfer ownership to VG Visuals UK
    • Does not necessarily represent a formal partnership
    • Does not necessarily represent sponsorship
    • Does not create an agency relationship
    • Does not necessarily represent reciprocal endorsement

    Third-party branding may not be extracted, copied or reused from the VG Visuals UK website without permission from the relevant rights holder.

    VG Visuals UK may resize or present supplied logos in an agreed monochrome format for consistency with the website design.

    A rights holder may contact VG Visuals UK to request a reasonable correction, update or removal of its branding.

  13. Website content

    All website content is provided for general information and promotional purposes.

    Although VG Visuals UK aims to keep information accurate, we do not guarantee that:

    Every photographer is currently available

    Prices displayed elsewhere remain current

    Every external link remains active

    Every gallery remains permanently available

    Website content will always be complete or error-free

    The website will operate without interruption

    VG Visuals UK may update, correct, remove or reorganise website content where reasonably necessary.

    Changes to these Terms will not retrospectively remove rights already granted under a separate signed agreement.

  14. External links

    The website may contain links to:

    • Photographer websites
    • Social-media profiles
    • WhatsApp
    • Galleries
    • Independent businesses
    • Third-party services

    External websites and services are controlled by their respective operators.

    VG Visuals UK is not responsible for their availability, security, privacy practices, content or transactions.

    Following an external link does not mean that VG Visuals UK controls or legally endorses everything published through that service.

    Visitors should review the relevant third party’s own terms and privacy information before using its services.

  15. Acceptable use

    You must not use the VG Visuals UK website or its content to:

    • Break the law
    • Harass, threaten or discriminate against another person
    • Impersonate VG Visuals UK, a photographer or another participant
    • Misrepresent an event as officially connected with VG Visuals UK
    • Copy or commercially exploit VG Visuals UK Media without permission
    • Extract or reuse third-party logos
    • Upload malware or interfere with website operation
    • Collect personal information without authority
    • Circumvent access controls
    • Make false or misleading representations about VG Visuals UK
    • Damage the reputation or rights of VG Visuals UK, its photographers or participants

    VG Visuals UK may restrict access, remove content or report conduct where reasonably necessary to protect the community, the website or another person’s legal rights.

  16. Responsibility and liability

    Nothing in these Terms excludes or restricts liability where doing so would be unlawful, including liability for:

    • Death or personal injury caused by negligence
    • Fraud or fraudulent misrepresentation
    • Deliberate unlawful conduct
    • Any responsibility that cannot legally be excluded

    Nothing in these Terms removes a person’s statutory consumer rights.

    VG Visuals UK is not responsible for the contractual performance of an Independent Private Booking between a customer and a photographer.

    To the extent permitted by law, VG Visuals UK is not responsible for loss caused solely by:

    • A photographer acting independently and outside an Official VG Visuals UK activity
    • Inaccurate information supplied by a third party
    • The availability or operation of an external website
    • A visitor’s unauthorised use of website material
    • Events outside VG Visuals UK’s reasonable control

    This clause does not excuse VG Visuals UK from responsibility for its own negligence or breach of a legal duty.

  17. Privacy and cookies

    VG Visuals UK’s collection and use of personal information is governed by its separate:

    • Privacy Notice
    • Cookie Notice
    • Cookie consent and preference controls

    These documents explain how VG Visuals UK handles information including:

    • Names and contact details
    • Website enquiries
    • Community applications
    • Social-media details
    • Identifiable photographs and video
    • Technical website and cookie information

    Cookie Settings must remain accessible through the website footer.

  18. Complaints and rights concerns

    Questions or complaints concerning the website, an Official VG Visuals UK Shoot, VG Visuals UK branding or VG Visuals UK-controlled media should be sent to vgvisualsuk@icloud.com

    Copyright, logo or privacy concerns should include:

    • The person making the request
    • The material concerned
    • The location where it appears
    • The basis of the request
    • Evidence of ownership or authority where relevant

    VG Visuals UK will acknowledge genuine complaints within5 working days and aim to provide a substantive response within 15 working days.

    Complaints about an Independent Private Booking should normally be directed to the photographer who supplied the service.

  19. Changes to these Terms

    VG Visuals UK may update these Terms to reflect:

    • Changes in how the community operates
    • Changes to website functionality
    • New legal or regulatory requirements
    • New services or activities
    • Reasonable corrections or clarifications

    The latest version will be published on the website with its effective date.

    Material changes will not retrospectively alter a signed copyright assignment, licence or booking agreement unless all relevant parties agree in writing.

  20. Governing law

    These Terms are governed by the law of England and Wales.

    Nothing in this section removes any mandatory rights a consumer may have under the law applying where they live.

    Any dispute should first be raised with VG Visuals UK so that the parties can attempt to resolve it informally.

    Where court proceedings are necessary, they will be dealt with by the courts having lawful jurisdiction over the dispute.

  21. General provisions

    If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

    A delay by VG Visuals UK in enforcing a right does not mean that the right has been waived.

    Nothing in these Terms creates an employment relationship, partnership, joint venture or agency relationship between VG Visuals UK and an independent photographer, participant or featured business.

    These website Terms do not replace any separate written:
